The British Nationality (Regularisation of Past Practice) Act 2023 confirms British citizenship to children of EU citizens exercising free movement in the UK.
Until now, most children born between 1 January 1983 and 1 October 2000 to EU citizens exercising free movement in the UK (at the time of their birth) were automatically granted citizenship by the Home Office.
However, this rule was not enshrined in law, meaning that some people had to apply for citizenship (even if they were born in the UK) and had their applications rejected.
This new legislation aims to provide clarity on this matter and bring peace of mind to all the families that fall under this category.
