Completing a valid UK spouse visa application is a complicated and long-winded process.
If your application does not meet the strict requirements, the Home Office will simply refuse your application and you will have to re-apply, or submit an appeal against the decision.
The Home Office has tightened the requirements in order to ensure that foreign spouses can be financially maintained in the UK, without recourse to public funds.
It is also to ensure that sham marriage applications do not get approved.
Joining your spouse
A UK spouse visa allows applicants to join their spouse initially for two and a half years.
Whilst eligible to work in the UK on this visa, a non-British spouse may not claim most benefits, or housing assistance.
In order to apply under the spouse visa, the applicant’s partner must already be a British citizen, or be settled in the UK (through Indefinite Leave to Remain, settled status or permanent residence).
In addition, there are a number of other mandatory requirements, relating to English, finances and accommodation which need to be met.
